This Internet service (“Service”) branded as The Centre Free WiFi, is owned and operated by The Centre and its corporate owners, agents, managers and affiliates (the “OWNERS”) and is available for your use provided that you agree to and comply with these terms and conditions (“Policy”). Before using this Service, you must read this Policy. If you do not agree to comply with this Policy, you may not use this Service.
Acceptable Use – Your use of this Service must be lawful, ethical, and respectful of the legal rights and interests of others. You may not use this Service to access, download, view, transmit or send any materials, data, information or other things that are unlawful, or that violate any person’s rights, or that are otherwise objectionable (for reasons such as, but not limited to, obscenity or the promotion of violence or hatred), or that affect other persons’ use of the Internet or their computers (such as, but not limited to, spam, viruses and unsolicited software). The OWNERS may, at its discretion, prevent any use of this Service that it deems in its sole discretion to be objectionable or a violation of this Policy. The OWNERS reserve the right at all times to disclose any information as it deems necessary to satisfy any applicable law, regulation, legal process or governmental request.
While using the Service, you may not post, transmit or otherwise distribute information constituting or encouraging conduct that would constitute a criminal offence or give rise to civil liability, or otherwise use the Service in a manner which is contrary to law or to The OWNERS’s then-current policies or would serve to restrict or inhibit any other user from using or enjoying the Service. Without limiting the foregoing, you agree not to use the Service for any commercial purpose not otherwise permitted by these Terms and Conditions.
Limitation and Exclusion of Liability – The OWNERS provides this Service on an “as is, where is” basis, without representations, warranties or promises of any kind. You agree to indemnify and hold THE OWNERS, its affiliates, agents and suppliers harmless from all liabilities and expenses related to any violation of these Terms and Conditions by you or any user, or in connection with your or their use of the Service. All information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials ("Content") posted by any users are the sole responsibility of those users. The OWNERS does not guarantee the accuracy, copyright compliance, legality, integrity, quality, or decency of such Content.
The OWNERS will not be responsible for any corrupted files or viruses which affect the user of the Service. It is your responsibility to safeguard your system, through appropriate means (e.g. using commercially available software), from theft, unauthorized use or system corruption. Any detriment caused to the network as a result of your failure to properly secure your system may result in the immediate termination of your Service. THE OWNERS cannot ensure or guarantee privacy for users of the Service. It is therefore recommended that the Service not be used for the transmission of confidential information. Any such use shall be at your sole risk and the OWNERS, its affiliates and its agents shall be relieved from all liability in connection therewith.
This service may contain links to third party sites ("Linked Sites"), and may incorporate information obtained from third parties ("Third Party Information"). The Linked Sites and Third Party Information are not under the control of the OWNERS, and the OWNERS are not responsible for the contents of any Linked Site or Third Party Information, including without limitation the accuracy, copyright compliance, legality, decency, links or any other aspect of the Linked Sites.
Any dealings with third parties conducted through the service, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the third party. The OWNERS shall not be responsible or liable for any part of any such dealings.
Performance Transmission speed is a function of the bottlenecks experienced upon the wider network architecture of the Internet itself as well as the geographic environment in which the network may be deployed. As such The OWNERS do not guarantee the Service performance.
Intellectual Property and Copyrights Neither you nor anyone acting on your behalf, acquire any intellectual property or other proprietary rights, including patents, designs, trademarks, copyright or trade-secrets, relating to the content of this service, including without limitation, software and information.
Privacy Statement The OWNERS respects the privacy and personal electronic communication of the users of this Service. Our Service is intended for adult audiences, and THE OWNERS does not knowingly collect any personal information from anyone under 13 years of age. Now, or in the future, THE OWNERS may collect, store and use your personal profile information to create personalized content, or to tailor services and advertising on or related to individuals identified as likely consumers to benefit from the personalized content.
The OWNERS may also compile store and use personal information and usage statistics such as usage patterns, travel patterns and website page views. The OWNERS may also use this information for statistical purposes to improve the Service and to manage our networks and systems more efficiently. The OWNERS may also record the MAC (Media Access Controller) address from the network card, or any other hardware or software platform information used with your computer or other devices to enable The OWNERS to accurately perform the service or for any other purpose disclosed herein.
The OWNERS strongly recommends that its customers take measures to ensure the security of their data across ANY Internet connection. Like any high-speed service, including DSL and cable, The OWNERS Services are not inherently secure. We recommend the active use of security solutions such as personal firewalls, anti-virus software, virtual private networks and encryption, though we do not provide these solutions for our users and cannot guarantee their effectiveness. It is the user's responsibility to evaluate their personal needs and workplace requirements, and obtain and properly configure appropriate security measures.
